Submitting complaints to the Danish University and Property Agency
Legal issues relating to the universities’ decisions on student matters may be referred to the Danish University and Property Agency.
Who can lodge a complaint?
You can file a complaint with the Danish University and Property
Agency if you are a student at a Danish university.
The university must have finished processing your case and made a final
decision in the case before you can file a complaint with the
Agency.
What can you lodge a complaint about?
You can file a complaint with the Agency about the legal issues in
relation to a decision made by the university.
This means that you can complain if you believe that the university’s
decision is in contravention of applicable legislation, including the
provisions set out in the University Act, rules laid down in pursuance
of the University Act (the education rules), other legislation (e.g.
the Public Administration Act (Forvaltningsloven) and the
Consolidation Act on Gender Equality (Lov om ligestilling af
kvinder og mænd)) and general public administration
principles.
The Agency cannot make decisions on the academic judgments made by the
university’s competent bodies pursuant to the University Act etc.,
unless an illegal judgment has been made.
How do you lodge a complaint?
When the university has made a decision against which a complaint
can be filed with the Agency, the decision will be accompanied by more
detailed complaints guidelines which you must follow.
This normally means that you can file your complaint with the
university, which will then forward the complaint to the Agency
together with a statement which you must have a chance to comment on
before it is submitted to the Agency. The university also ensures that
the relevant documents in the case are submitted to the Agency along
with your complaint.
The deadline within which you must file your complaint will appear from
the complaints guidelines. It is very important that you observe the
deadline for complaints as the complaint will otherwise, as a general
rule, be dismissed.
